1. Controller

MARKTIX AG is solely responsible for the operation, content, comparison services, data processing, and the brokering of contract conclusions on internet-deals.de.

Any claims relating to the use of the platform, the brokering of contracts, or the processing of personal data must be asserted exclusively against MARKTIX AG, to the extent legally permissible.

EU representative pursuant to Art. 27 GDPR

As MARKTIX AG is headquartered in Switzerland, and thus outside the EU, but its offer is directed at persons in the EU, it has appointed the following representative in the Union pursuant to Art. 27 GDPR:

You can additionally contact the EU representative with any data protection concerns. Responsibility under data protection law remains exclusively with MARKTIX AG; the appointment of the representative does not establish an establishment in Germany.

2. Principle

The protection of your personal data is a key concern for us. This privacy policy informs you which data we collect, how we use it, and what rights you have. Data processing is carried out in accordance with the General Data Protection Regulation (GDPR) and the German Telecommunications-Digital-Services-Data Protection Act (TDDDG) and, where applicable, the Swiss Federal Act on Data Protection (FADP).

4. Tools and third-party providers used

• Our own traffic measurement — Analysis on our own servers, no disclosure to third parties and no advertising network. Two pseudonymous identifiers are stored in your browser (see cookie policy). This only happens after you have chosen "Allow statistics" in the banner; if you decline, no measurement takes place and nothing is stored.
• Meta Pixel (Meta Platforms Ireland Ltd., Merrion Road, Dublin 4, Ireland) — We advertise internet-deals.de with ads on Facebook and Instagram. To measure whether these ads lead to visits and enquiries, and to allow Meta to show relevant ads, we use the Meta Pixel. It is only loaded after you have allowed the "Marketing" category in the banner; if you decline, nothing is sent to Meta. With your consent Meta receives your IP address, browser and device data, the pages you view and the identifiers from the Meta cookies (_fbp, possibly _fbc) and may link them to your Meta account if you have one. For the collection and transfer we are joint controllers with Meta (Art. 26 GDPR, Controller Addendum); for the subsequent processing Meta is solely responsible, see Meta's privacy policy. Data may be transferred to the USA; Meta Platforms, Inc. is certified under the EU-US Data Privacy Framework. You can withdraw your consent at any time via the cookie settings.
• Awin (affiliate network) — If you click on a provider link, you will be redirected to the respective provider's website via the affiliate network Awin (AWIN AG, Berlin, Germany). Awin records that the redirection took place via internet-deals.de in order to attribute the referral commission. Details can be found at awin.com.
• communicationAds (affiliate network) — For some providers (including PYUR, Deutsche Glasfaser and simyo) the redirection runs through the communicationAds network (communicationads.net). Here, too, only the fact that the redirection came from internet-deals.de is recorded.
• Call centre service provider (YzeeCall) — If you request a callback, we pass your details to the call centre platform YzeeCall (api.live.calleebree.io), through which the call is made. The provider is bound as a processor under Art. 28 GDPR, acts solely on our instructions and may not use your data for its own purposes. The advisers involved work in the EU or in Switzerland.
• Hosting and email service providers — Operation of our servers and sending and receiving of our email. These providers are likewise bound as processors under Art. 28 GDPR.
• Newsletter — Sending is done through our own system with double opt-in; addresses are not passed on to third parties.

Processing takes place predominantly in Germany, the EU or Switzerland. Where data is transferred to a third country in individual cases, this is based on the EU Standard Contractual Clauses (SCC); for transfers from Switzerland, the Swiss Standard Contractual Clauses in accordance with the FDPIC also apply.

5. Cookies

We distinguish three categories of cookies and comparable storage technologies:

• Necessary — required to run the website, for example to remember your choice in the consent banner. No consent is required for these under Section 25(2) TDDDG.
• Statistics — the pseudonymous identifiers used by our own traffic measurement. They are not required to run the site and are therefore only stored once you have expressly agreed in the banner at the bottom of the screen (Section 25(1) TDDDG, Art. 6(1)(a) GDPR).
• Marketing — the Meta Pixel cookies (_fbp, possibly _fbc) used to measure our advertising on Facebook and Instagram. They too are only set once you have expressly agreed in the banner (Section 25(1) TDDDG, Art. 6(1)(a) GDPR).

We do not use any further marketing or advertising cookies. You can change your choice at any time with effect for the future, using the "Cookie settings" button in the cookie policy. You can also delete stored data at any time via your browser settings.

When you click on a provider link, cookies may be set on the target page or by the affiliate networks Awin and communicationAds. This takes place outside internet-deals.de under the sole responsibility of the respective provider or network.

6. Contract conclusion and data disclosure

A contract for a mobile, internet or TV plan is not concluded on internet-deals.de. When you click on a provider link, you are redirected to the respective provider's website and conclude the contract directly with the provider there. You enter all data required for this directly with the provider; MARKTIX AG does not transmit any personal data to the provider in this process.

If you use the free callback or consultation service, your details (name, phone number, email if applicable, and preferred appointment time) are used exclusively for the purpose of contacting you and providing consultation. MARKTIX AG remains the controller; the call itself is made through the call centre platform YzeeCall, which acts for us as a processor under Art. 28 GDPR (see section 4). Your data is not passed on to the providers being compared.

Newsletter (double opt-in)

For the newsletter, we use the double opt-in procedure: after you sign up, you receive an email with a confirmation link; only after clicking it do we add you to the distribution list. Your consent is logged for evidence purposes (time, IP address and version of the consent text). You can unsubscribe from the newsletter at any time, with effect for the future, via the unsubscribe link in every email or by sending us a message.

Telephone advice / callback

We only carry out a telephone callback or telephone advice on the basis of your prior express consent (Section 7 (2) No. 1 UWG in conjunction with Art. 6 (1) (a) GDPR). To prove this consent, we store the time, IP address and the version of the consent text. You can revoke your consent at any time with effect for the future, e.g. by email to the address given in the legal notice or in conversation with our staff.

WhatsApp chat

We offer a chat via WhatsApp (WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland). The chat only starts when you click the WhatsApp button or scan the QR code shown with your smartphone; simply visiting our pages does not transmit any data to WhatsApp. If you write to us via WhatsApp, we process your phone number, your profile name and the content of your message in order to answer your enquiry (Art. 6(1)(b) and (f) GDPR). WhatsApp receives metadata of the communication; that processing is governed by WhatsApp's privacy policy (whatsapp.com/legal/privacy-policy-eea). We delete chat histories as soon as your enquiry has been answered conclusively and no statutory retention obligations apply. If you prefer not to use WhatsApp, you can reach us at any time by email or via the callback form.

Voucher campaign

To claim the €25 voucher, send us the provider's order confirmation to gutschein@internet-deals.de. We process the details it contains (name, email address, contract data) solely in order to check your entitlement — for which we verify whether the contract came about via internet-deals.de — and to send you the voucher (Art. 6(1)(b) GDPR). The details are not used for advertising and are deleted once the campaign has been settled, unless statutory retention obligations apply. You will find the campaign terms in our terms of use.

7. Storage period

• Traffic/usage data (only with your consent): for as long as it is needed for the statistical analysis of our service. If you withdraw your consent, measurement stops immediately and the identifier is removed from your browser.
• Meta Pixel (only with your consent): the _fbp cookie lasts 90 days; the retention period at Meta is governed by their privacy policy. After withdrawal we no longer load the pixel.
• Callback and contact requests: up to 24 months after last contact
• Newsletter data: until unsubscribed
• WhatsApp chat histories: until your enquiry has been answered conclusively
• Documents relating to the voucher campaign: until the voucher has been settled, subject to statutory retention obligations
