1. Scope and Responsibility
These terms of use apply to the use of the website internet-deals.de, operated by MARKTIX AG, Sinserstrasse 65, 6330 Cham, Switzerland (hereinafter the "Operator"). By accessing the website, the user accepts these terms.
MARKTIX AG is solely responsible for the operation, content, comparison services, data processing, and the brokering of contract conclusions on internet-deals.de.
Any claims relating to the use of the platform, the brokering of contracts, or the processing of personal data must be asserted exclusively against MARKTIX AG, to the extent legally permissible.
2. Description of Services and How It Works
internet-deals.de is an independent comparison portal for mobile, internet, and TV plans in Germany. MARKTIX AG provides comparison information and is financed through referral commissions from providers.
The process works as follows:
- Comparison: The user compares offers on the platform with no obligation.
- Redirect to the provider: If the user clicks on an offer, they are redirected via a partner/affiliate link to the respective provider's website. Any contract is concluded exclusively there and directly between the user and the provider. The provider provides all contract documents, mandatory information, and withdrawal notices.
- Free callback/advisory service: Alternatively, the user can leave their contact details for a non-binding callback. MARKTIX AG will then advise them by phone. This does not establish a contractual relationship.
- Compensation: MARKTIX AG receives a referral commission from the respective provider. This has no effect on the price paid by the user.
MARKTIX AG does not itself conclude contracts on behalf of the user and is not a party to the contracts concluded with the provider. The terms and conditions of the respective provider are exclusively decisive for the content of the contract.
3. No Contractual Partnership
MARKTIX AG is not a party to the contracts concluded between the user and the provider. It assumes no liability for the content, terms, or fulfillment of these contracts.
4. User Reviews
Users can submit reviews about providers. The Operator may remove reviews without giving reasons, in particular if they are offensive, untrue, or unlawful. There is no right to publication. By submitting a review, the user grants MARKTIX AG an unlimited right of use, in terms of both time and location, to this content.
5. Newsletter
The newsletter service requires explicit consent (double opt-in). Unsubscribing is possible free of charge at any time via the unsubscribe link in the newsletter.
6. Callback and Advisory Service
The Operator offers a free callback and advisory service. This is non-binding and does not create a contractual relationship. MARKTIX AG reserves the right to restrict or discontinue this service at any time.
7. Availability
The Operator strives for high availability but does not guarantee uninterrupted operation. Maintenance work can take place at any time without prior notice.
8. Limitation of Liability
MARKTIX AG is liable only for damages caused by intentional or grossly negligent conduct. No liability is assumed for indirect damages, lost profits, or data loss.
9. Changes
The Operator reserves the right to change these terms of use at any time. Changes will be published on the website. Continued use after a change is deemed acceptance.
10. Right of Withdrawal / Cancellation
MARKTIX AG is not a party to the contracts concluded between the user and the provider. Therefore, the party to whom a right of withdrawal for brokered contract conclusions must be addressed is exclusively the respective provider (Telekom, Vodafone, O2, etc.), not MARKTIX AG.
The statutory right of withdrawal under German and EU consumer law remains unaffected. Consumers can generally withdraw from a distance contract within 14 days without giving reasons. The right-of-withdrawal notice and terms and conditions of the respective provider are decisive.
Please direct inquiries regarding cancellation or withdrawal directly to the respective provider. MARKTIX AG can assist you with this upon request.
11. Severability Clause
Should individual provisions of these terms of use be or become invalid, the validity of the remaining provisions shall remain unaffected.
12. Applicable Law and Jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.
For disputes with businesses, the place of jurisdiction is Zug, Switzerland. For consumers, the statutory places of jurisdiction apply.
13. Dispute Resolution
MARKTIX AG is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
