Terms of Use

1. Scope and Responsibility

These terms of use describe how the website internet-deals.de works, which services MARKTIX AG, Sinserstrasse 65, 6330 Cham, Switzerland (hereinafter the "Operator") provides, and which rules apply to its use. Using the website is free of charge and does not create any paid contract.

The individual functions — callback, newsletter and voucher campaign — are governed by the conditions described for each of them below; we point to those conditions at the relevant place. Statutory rights, in particular consumer rights, remain unaffected in any case.

MARKTIX AG is solely responsible for the operation, content, comparison services, data processing, and the brokering of contract conclusions on internet-deals.de.

Any claims relating to the use of the platform, the brokering of contracts, or the processing of personal data must be asserted exclusively against MARKTIX AG, to the extent legally permissible.

2. Description of Services and How It Works

internet-deals.de is an independent comparison portal for mobile, internet, and TV plans in Germany. MARKTIX AG provides comparison information and is financed through referral commissions from providers.

The process works as follows:

• Comparison: The user compares offers on the platform with no obligation.
• Redirect to the provider: If the user clicks on an offer, they are redirected via a partner/affiliate link to the respective provider's website. Any contract is concluded exclusively there and directly between the user and the provider. The provider provides all contract documents, mandatory information, and withdrawal notices.
• Free callback/advisory service: Alternatively, the user can leave their contact details for a non-binding callback. MARKTIX AG will then advise them by phone. This does not establish a contractual relationship.
• Compensation: MARKTIX AG receives a referral commission from the respective provider. This has no effect on the price paid by the user.

MARKTIX AG does not itself conclude contracts on behalf of the user and is not a party to the contracts concluded with the provider. The terms and conditions of the respective provider are exclusively decisive for the content of the contract.

3. No Contractual Partnership

MARKTIX AG is not a party to the contracts concluded between the user and the provider. It assumes no liability for the content, terms, or fulfillment of these contracts.

4. Order and Selection of Offers

internet-deals.de compares a selection of plans, not the entire German market. The Operator decides which providers are included; providers have no claim to be listed.

In the default view, offers are shown in an order set editorially by us. The decisive factors are the price-performance ratio, how current and reliable the plan data is, and whether an offer is currently available. Providers with whom a commission agreement exists may be placed more prominently — but the commission has no effect on the price you pay at the provider. You can change the order in the lists yourself at any time, for example by price ascending or descending.

User reviews cannot currently be submitted on internet-deals.de. Ratings shown are taken from publicly available sources and from the providers' own information; they are not consumer reviews verified by us within the meaning of Section 5b(3) UWG.

5. Newsletter

The newsletter service requires explicit consent (double opt-in). Unsubscribing is possible free of charge at any time via the unsubscribe link in the newsletter.

6. Callback and Advisory Service

The Operator offers a free callback and advisory service. This is non-binding and does not create a contractual relationship. A callback is only made after you have requested it yourself and consented to the call; you can withdraw that consent at any time, including during the call. The call is made by a call centre service provider acting for us as a processor (see our privacy policy). MARKTIX AG reserves the right to restrict or discontinue this service at any time.

7. Communication Channels and Availability

You can reach us by email, through the callback form and via WhatsApp. We do not operate a phone number for incoming calls.

The WhatsApp chat is run on the WhatsApp Business app by staff of MARKTIX AG. The chat only starts when you write to us; we do not contact you on WhatsApp on our own initiative and send no advertising through it. Our service hours apply to messages: Monday to Friday 8 a.m. to 8 p.m., Saturday 9 a.m. to 5 p.m. Outside these hours you can still write to us and we will reply on the next service day. We do not promise a reply within any particular period.

If you prefer not to use WhatsApp, email and callback are available to you on equal terms.

8. Voucher Campaign (€25)

For certain offers, expressly marked as such on the website, the Operator gives a voucher worth €25. The following campaign terms apply:

• Who can take part: consumers resident in Germany who conclude a contract via internet-deals.de with a provider marked as voucher-eligible. What counts is the marking on the relevant offer page at the time the contract is concluded.
• How to claim: send the provider's order confirmation to gutschein@internet-deals.de. We check whether the contract came about via internet-deals.de and then send you the voucher by email.
• When it is sent: after the statutory withdrawal period for the provider contract has expired and once the provider has confirmed the contract. If the contract is withdrawn, cancelled or rejected by the provider, there is no entitlement to the voucher; a voucher already sent may be reclaimed in that case.
• Redemption: the voucher is a WUNSCHGUTSCHEIN multi-retailer gift voucher issued by Wunschgutschein GmbH and can be redeemed online at more than 500 partner shops (overview: wunschgutschein.de/pages/partnershops). It is valid until the end of the third year following the year of issue. The voucher issuer's redemption terms apply in addition.
• Other: cash payment is excluded. One voucher is granted per contract. The Operator may end the campaign at any time with effect for the future; entitlements already acquired remain unaffected.

9. Availability

The Operator strives for high availability but does not guarantee uninterrupted operation. Maintenance work can take place at any time without prior notice.

10. Liability

MARKTIX AG is liable without limitation for damage arising from injury to life, body or health caused by a breach of duty by the Operator or its agents, as well as for damage caused intentionally or by gross negligence, for fraudulently concealed defects, within the scope of a guarantee given, and under the German Product Liability Act.

In cases of simple negligence, MARKTIX AG is liable only for breach of a material contractual obligation, that is an obligation whose fulfilment makes proper performance possible in the first place and on whose observance you may regularly rely. In such cases liability is limited to the foreseeable damage typical for this type of contract. Liability for simple negligence is otherwise excluded.

The respective provider is solely liable for the content, prices and performance of contracts concluded with that provider.

11. Changes to These Terms of Use

The Operator may change these terms of use for the future, for example where the service, the technology used or the legal situation changes. The version published on the website always applies; the date of the last change is shown at the top of this page.

A change does not have retroactive effect. For services you have already requested — such as a voucher promised to you or a callback arranged with you — the version published at the time of your request applies. We do not treat mere continued use as tacit acceptance.

12. Right of Withdrawal / Cancellation

MARKTIX AG is not a party to the contracts concluded between the user and the provider. Therefore, the party to whom a right of withdrawal for brokered contract conclusions must be addressed is exclusively the respective provider (Telekom, Vodafone, O2, etc.), not MARKTIX AG.

The statutory right of withdrawal under German and EU consumer law remains unaffected. Consumers can generally withdraw from a distance contract within 14 days without giving reasons. The right-of-withdrawal notice and terms and conditions of the respective provider are decisive.

Please direct inquiries regarding cancellation or withdrawal directly to the respective provider. MARKTIX AG can assist you with this upon request.

13. Severability Clause

Should individual provisions of these terms of use be or become invalid, the validity of the remaining provisions shall remain unaffected.

14. Applicable Law and Jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.

For disputes with businesses, the place of jurisdiction is Zug, Switzerland. For consumers, the statutory places of jurisdiction apply.

15. Dispute Resolution

MARKTIX AG is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
